Abstract
This article examined the impact of the Nigerian Civil War (1967–1970) on the evolution of International Humanitarian Law (IHL) governing non-international armed conflicts. It analyzed the humanitarian crisis that arose during the conflict, particularly mass starvation, civilian casualties, and restrictions on humanitarian relief, and evaluated the adequacy of the legal framework applicable at the time, especially Common Article 3 of the 1949 Geneva Conventions. The study adopted a doctrinal research methodology, relying on treaty provisions, customary international humanitarian law, judicial decisions, scholarly literature, and historical materials to assess the conflict's contribution to the evolution of contemporary IHL. It further examined how the humanitarian consequences of the war informed the adoption of the 1977 Additional Protocols, strengthened legal protections for civilians, reinforced the prohibition of starvation as a method of warfare, and contributed to the progressive development of customary international humanitarian law. The article argued that although the Nigerian Civil War was not the sole catalyst for subsequent legal reforms, it constituted an important experiential reference point in the doctrinal and normative evolution of the law governing non-international armed conflicts. It concluded by recommending measures to strengthen the enforcement, domestication, and implementation of International Humanitarian Law obligations in Nigeria and other jurisdictions confronting contemporary internal armed conflicts.
